ELEMENTS CLUB TERMS AND CONDITIONS

1 - The Programme

(1.1) The ELEMENTS CLUB Loyalty Programme (hereinafter called the “Programme”) is offered by ELEMENTS to customers. Under the Programme, ELEMENTS CLUB’s Members (hereinafter referred to as “Members”) who accumulate sufficient ELEMENTS Points may redeem them for rewards (hereinafter referred to as “Rewards”).

(1.2) The Programme shall remain available to eligible Members until ELEMENTS terminates the Programme.

 

2 - Eligibility and Membership

(2.1) The Programme is open to the public through registration on the ELEMENTS APP. Selected customers may also be invited to participate, subject to the terms and conditions of their invitation.

(2.1.1) To become a Member, a customer who has successfully registered a valid account using an email address must complete the email verification process and create a personal password via the ELEMENTS APP.

(2.1.2) Each Member may hold only one membership at a time.

(2.2) Eligibility for membership shall be determined solely at the discretion of ELEMENTS. ELEMENTS' decision as to whether an individual is eligible for membership shall be final and binding and shall not be open to challenge.

(2.3) The Member acknowledges that ELEMENTS may, at its sole discretion, modify, restrict, suspend, withdraw or terminate the Programme, in whole or in part, with or without notice at any time to the Member or Members (as the case may be), except as specifically provided herein.

(2.4) If, in ELEMENTS' sole opinion, a Member abuses any of the Programme privileges, fails to comply with any of the terms and conditions herein or makes any misrepresentation to ELEMENTS, ELEMENTS reserves the right to terminate the Member's membership in the Programme or revoke all the ELEMENTS Points that have been earned by the Member. ELEMENTS' determination shall be final and conclusive.

 

3 - ELEMENTS CLUB Membership Eligibility and Validity

(3.1) Membership lasts for 365 days from the date that the Member enrolled, renewed, upgraded or downgraded to the current tier.

(Example: If membership starts on 1 November 2025, membership will remain valid until 31 October 2026.)

(3.2) There are five tiers of Membership in ELEMENTS CLUB: Red, Silver, Gold, Platinum and Diamond.

(3.2.1) Tier Advancement Criteria

Subject to Clause 3.1 and 3.2.2, Membership tiers are promoted based on cumulative spending as follows:

* Or such other spending amount as The ELEMENTS CLUB may decide from time to time.

(3.2.2) Notwithstanding any extra amount being expended in the current membership year, the Member may only progress to one membership tier at a time. Once the required spending is met, the upgrade will be processed within seven (7) working days, and the new membership tier will be valid for 365 days.

(3.3.3) Any balance left or spending that exceeds the amount required for a membership upgrade will be forfeited upon upgrade and shall not be counted toward any future membership renewal or subsequent upgrade.

(3.2.4) Failure to Qualify For Upgrade

If Member does not meet the qualifying spend for the next tier within the membership year:

- the Membership will automatically renew for 365 Days at either the current tier or the next lower tier, depending on the total spending accumulated during the current membership year; and

- all remaining ELEMENTS Points and accumulated spending during the qualification period will be forfeited and reset to zero.

(3.3.1) Membership will automatically renew for 365 Days upon expiration. If the spending requirement for the current tier is not met, the membership will automatically renew for 365 Days at the next lower tier.

(3.3.2) All remaining ELEMENTS Points and annual cumulative spending will be reset to zero and cannot be carried forward.

(3.3.3) Any balance left or spending that exceeds the amount required for a membership renewal will be forfeited upon renewal and will not count toward any future membership renewal or subsequent upgrade.

(3.4) Membership Privileges

Members are entitled to different privileges based on their membership tier, as indicated in the ELEMENTS APP. If a Member’s tier changes during the membership year, the new privileges and quotas will take effect immediately, and the membership validity will be adjusted according to the nature of the tier change.

 

4 - Earning ELEMENTS Points

(4.1) Points Accumulation

(4.1.1) Each receipt of HK$100 or above, paid via electronic payment (including but not limited to credit card, debit card, Alipay, WeChat Pay, Apple Pay, Google Pay, EPS or other types of electronic payment methods as permitted by ELEMENTS from time to time), at a Qualifying Tenant in ELEMENTS, is eligible for ELEMENTS Points registration.

"Qualifying Tenants" refers to participating tenants listed on the ELEMENTS website (www.elementshk.com).

(4.1.2) Any decimal in the payment amount or ELEMENTS Points balance shall be rounded down to the nearest whole number.

(4.1.3) Members may redeem ELEMENTS Points for Rewards as displayed in the ELEMENTS APP or under any special Rewards Offer Programme as determined by ELEMENTS. ELEMENTS reserves the right to change the ELEMENTS Points earning rate at any time without notice.

(4.2) Registration of Receipts

Each printed receipt and corresponding payment slip must be registered at the designated counters or submitted via the ELEMENTS APP. ELEMENTS Points will be calculated based on the total spending show on valid receipts and payment slips. Occasionally, through specified promotions, additional bonus ELEMENTS Points or other benefits may be awarded to Members.

(4.2.1) Transactions must be registered within 30 days from the purchase date or on/after 1 November 2025 (whichever is later), and in any case no later than the membership expiry date. ELEMENTS Points will only be calculated based on spending made after enrollment in the applicable membership tier.

(4.2.2) Members must retain all supporting documents for 12 months from the date of receipt registration or until such time that all documents have been duly submitted for verification.

(4.2.3) Purchases made by Members at all outlets in ELEMENTS are eligible for spend accumulation towards Points and Rewards redemptions, except for the followings: banks, clinics, Mainland Coach Terminus, membership payment, bill payment, purchase of gift cards, purchase and use of cash coupons or gift vouchers, value-added cards, purchase of products or services with special discounts or offers provided by tenants, deposits on merchandise and meals, reloading of Octopus Card, parking, wedding banquets, purchase of 999.9 gold and deposits for gold savings club (not including decorated gold), Pop Up Stores, private and corporate functions at restaurant outlets,. Reprinted, photocopied or handwritten receipts will not be accepted.

(4.2.4) If a Member wishes to cancel a purchase and obtains a refund and such purchase has earned bonus points, the Member must first return the earned ELEMENTS Points before requesting a refund from the merchant. If the Member attempts to obtain a refund using receipts that have already earned ELEMENTS Points, ELEMENTS shall reserve the right to deduct corresponding points from the Member’s account. Additionally, the Member must return any redeemed rewards or gifts or pay the appropriate fee for any activity joined as a reward, as determined by ELEMENTS.

(4.2.5) The value of an ELEMENTS gift voucher used in a purchase shall not be eligible for spend accumulation towards Points / Rewards redemptions.

(4.2.6) Each tenant-printed receipt may only be registered once, either for ELEMENTS Point accumulation or for ELEMENTS gift voucher redemption. Once a transaction has been successfully submitted, it cannot be changed. Only receipts and corresponding payment slips (if applicable) bearing the same name as the registered Member of ELEMENTS CLUB will be accepted for Points registration or Rewards redemptions.

(4.2.7) Staff of ELEMENTS have the right to request that a Member present a proof of identity, the payment receipt or transaction record matching the electronic payment slip (including but not limited to credit card or EPS slip counterfoils), and any other relevant information for verification and confirmation of the related transaction.

(4.2.8) ELEMENTS reserves the right to record and scan the eligible receipts and corresponding electronic payment slips for internal reference and verification.

(4.2.9) For the benefit of Members, only machine printed receipts and the corresponding electronic payment slip will be accepted as valid Receipts for earning ELEMENTS Points. Such receipts must clearly display the name of the Qualifying Tenant, shop address, invoice number, transaction date, transaction amount, payment details and the purchased product or service items. The name of the Qualifying Tenant and shop address shown on the machine printed receipt must match those on the corresponding payment slip (if applicable). For spending at the cinema, Members must present the original movie ticket(s) and the corresponding payment slip to earn ELEMENTS Points. All damaged, altered or otherwise or modified receipts will be deemed forfeited.

(4.2.10) To register receipts in excess of HK$100,000, a Member must visit the Redemption Counter in person.

(4.2.11) Only one receipt and one corresponding electronic payment slip (if applicable) from a single transaction may be uploaded per registration. Submissions containing multiple receipts or multiple electronic payment slips from multiple transactions will not be accepted.

(4.2.12) The System service may be temporarily suspended due to App updates, maintenance or any other reasons. During such periods, Members are invited to register eligible spending at Redemption Counter.

(4.2.13) ELEMENTS reserves the right to withhold or otherwise disregard ELEMENTS Points earned from any transactions that ELEMENTS suspects to be fraudulent or improper, including but not limited to attempts to register ELEMENTS Points for transactions made by others. In such cases, membership may be suspended from all Programme activities for review until further notice.

(4.2.14) ELEMENTS reserves full right to change the basis on which ELEMENTS Points are awarded (including the number of ELEMENTS Points rewarded) at any time, without notice at ELEMENTS' sole discretion.

(4.2.15) ELEMENTS Points have no cash value and are not exchangeable for cash. ELEMENTS Points cannot be sold, purchased, assigned, or transferred, except as specifically provided in the terms herein or as may be allowed in special programme(s) by ELEMENTS at its sole discretion.

(4.2.16) Members can check their registered, accumulated ELEMENTS Points in the ELEMENTS App. ELEMENTS reserves the right to delay or postpone the crediting or debiting of ELEMENTS Points. In the absence of obvious error, the number of ELEMENTS Points shown in the ELEMENTS APP will be binding and conclusive.

(4.3) Points Deduction

ELEMENTS may, at its sole determination, deduct from the Member's remaining ELEMENTS Points:

(4.3.1) Any ELEMENTS Points suspected to be dubious or fraudulently recorded or earned by the Member;

(4.3.2) Any ELEMENTS Points recorded in error; and

(4.3.3) Any ELEMENTS Points relating to a transaction which has been cancelled.

 

5 - Redemption of Rewards

(5.1) The Member may redeem unexpired ELEMENTS Points for Rewards in accordance with prevailing offers or Programmes. ELEMENTS Points will be utilised on a first-in-first-out basis. Redemption of Rewards is subject to the Member having sufficient ELEMENTS Points and is subject to stock availability, which will be on a first come, first served basis.

(5.1.1) The Rewards that may be redeemed as physical gifts using ELEMENTS Points (whether featured on the ELEMENTS APP or any other medium) are provided "AS IS" without product liability or warranties of any kind, including warranties of merchantability, non-infringement of intellectual property, or fitness for a particular purpose. ELEMENTS does not warrant or make any representations regarding the use, validity, accuracy, reliability, or results of the use of such Rewards, or, in respect of the materials on the ELEMENTS APP or any sites linked to the ELEMENTS APP. Under no circumstances (including but not limited to negligence, omission or default) shall ELEMENTS be liable for any direct, indirect, special, incidental or consequential damages whatsoever, including, but not limited to, loss of profits, business interruption or loss of information or data, arising from the use or inability to use the Rewards, even if ELEMENTS or its representatives have been advised of the possibility of such expectation.

(5.2) All redemptions must be made following the Member’s successful request submitted to ELEMENTS CLUB and are subject to the accumulation of sufficient ELEMENTS Points and ELEMENTS' final approval. Only the required ELEMENTS Points for the Rewards redemption will be deducted from the Member's account. Requests will not be processed if the Member does not have sufficient ELEMENTS Points.

(5.3) ELEMENTS reserves the right to change these terms and conditions, as well as the amount of ELEMENTS Points required for redemption at any time without notice.

(5.4) Rewards redeemed as vouchers ("Vouchers") shall be collected by Members at the designated redemption counter. Rewards redeemed as physical goods shall be collected by Members from the merchants supplying those goods, as detailed in the ELEMENTS APP.

(5.4.1) Redeemed gifts shown in the Member Account of the ELEMENTS APP that are not collected or used before the Gift Redemption / Collection Date will be automatically forfeited, with no refund of rewards or points.

(5.4.2) Member must redeem rewards via the ELEMENTS APP and redeemed rewards will be stored in the ELEMENTS APP until the physical collection or use of the Rewards item / physical gift (“Rewards Gift”), or until the end of Reward Redemption / Collection Date as stated.

(5.5) All Rewards redeemed by the Member cannot be exchanged for cash, revoked or cancelled by the Member, and no cash refund will be given.

(5.6) Vouchers are not redeemable for cash. Their use is also subject to the terms and conditions stipulated by the merchants supplying them.

(5.7) For Vouchers, merchandise, products and services redeemable under the Programme that are not issued or provided by ELEMENTS, ELEMENTS CLUB is not the supplier of those items and accepts no responsibility for them.

(5.8) Collection of the Rewards must be made on or before the date as specified on the Redemption Notification issued by ELEMENTS CLUB. Any failure by the Member to do so for any reason will result in automatic forfeiture of the Reward. For the avoidance of doubt, the ELEMENTS Points used in the redemption of the Reward will not be returned or credited back to the Member, even if the Reward is not collected or, in the case of Vouchers, if the Redemption Notification could not be delivered due to the Member's own fault (e.g. furnishing incorrect contact information to ELEMENTS).

(5.9) The Member is advised to examine the Rewards Gift upon delivery. In the case of Vouchers, if the details are incorrect, the Voucher must be returned to ELEMENTS CLUB within 7 days of receipt. In the case of faulty, damaged, or defective goods, they must be returned immediately by the Member, at his or her own cost, in the original packaging to ELEMENTS CLUB within ONE (1) week from the date (a) receiving the Rewards Gift or (b) collecting the Rewards Gift, as the case may be.

(5.9.1) Neither ELEMENTS nor ELEMENTS CLUB will be responsible for the condition of the Rewards Gift, the operation of the Rewards Gift or any damage, loss or bodily injury arising from its use. All product liability, warranties or queries regarding redeemed Rewards should be directed to the original supplier or manufacturer. Any dispute concerning the Rewards (quality or otherwise whatsoever) shall be settled between the Member and the supplier or manufacturer that supplied the Rewards. Other than any limited warranty ELEMENTS may give in respect of its own products, ELEMENTS is not liable for any products warranty issues or for the quality or suitability of the Rewards and will bear no responsibility for resolving such disputes or for the dispute itself.

(5.10) All Rewards are subject to availability and restrictions may apply as to where and when the Rewards may be redeemed. ELEMENTS reserves the right, at its sole discretion, to discontinue any item or substitute a similar item of equal value at any time without notice, before that item is redeemed. ELEMENTS does not guarantee that any Rewards gifts will remain available.

(5.11) For any queries about redemption, the Member should write to ELEMENTS CLUB directly.

 

6 - ELEMENTS APP

(6.1) Each Member can log in ELEMENTS APP using a valid email address and password.

(6.2) Members can access their Membership Account via the ELEMENTS APP, which is for the sole and exclusive use of the Member. The Member shall not use or knowingly allow any other person to use the Services, the information and/or the reports for, or in connection with, any illegal purpose or activity. The Member shall notify ELEMENTS as soon as practicable if he becomes aware of such use.

(6.2.1) Members must present their e-membership card through the ELEMENTS App during operating hours at the designated Concierge Counter for any enquiries.

(6.3) The ELEMENTS APP allows Member to access their e-Membership Card (hereinafter called the “e-Membership Card”) and Member account to check the ELEMENTS point balance and view the latest redemption records.

(6.4) The Member shall act in good faith and exercise reasonable care and diligence in keeping the Email Address and Password. At no time and under no circumstances shall the Member disclose the Email Address or the Password to any other person.

(6.5) The Member shall be fully responsible for any accidental or unauthorised disclosure of the Email Address and/or the Password to any other person and shall bear the risks of the Email Address or Password being used by an unauthorised person or for unauthorised purposes.

(6.6) Upon notice or suspicion of the Email Address and/or the Password being disclosed to any unauthorised person, or any unauthorised use of the Services, the Member shall notify ELEMENTS in person as soon as practicable (and ELEMENTS may ask the Member to confirm in writing any details given). Until ELEMENTS' actual receipt of such notification, the Member shall remain responsible for any and all use of the Services by unauthorised persons or for unauthorised purposes.

(6.7) Advice or confirmation that an instruction has been received through the ELEMENTS APP will be provided by ELEMENTS. Such advice or confirmation shall be deemed to have been received by the Member immediately after transmission and it is the duty of the Member to check such advice or confirmation. It is also the duty of the Member to enquire with ELEMENTS if the Member does not receive such advice or confirmation within the time usually required for a similar advice or confirmation to be received.

(6.8) Information relating to any account or Reward Redemption request made available on the ELEMENTS APP is for reference only. ELEMENTS' records of such account and Reward Redemption request shall be conclusive unless and until the contrary is established.

(6.9) Members should ensure that their mobile device has a stable connection when registering receipts, redeeming gifts, or performing any related actions (if applicable).

(6.10) ELEMENTS retains the full and final right and discretion to decide whether to grant ELEMENTS Points to Members with respect to any dubious or faulty receipts, including but not limited to, unclear photo uploaded, duplicated submissions, or transactions paid by cash etc. The processing time for such receipts may be longer than normal. ELEMENTS also reserves the right to amend the information uploaded by the Member for their submission to earn ELEMENTS Points via ELEMENTS APP from time to time, and ELEMENTS shall make the final decision in case of any dispute.

 

7 - Intellectual Property

(7.1) The components of ELEMENTS CLUB communication materials (including, but not limited to, printed materials and ELEMENTS APP), including text, graphics, logos, designs and photographs, are protected by Hong Kong and international copyright laws. They must not be reproduced or used without express permission of ELEMENTS.

(7.2) It is hereby agreed and acknowledged that all intellectual property rights related to such logos and/or images, or from their use, shall remain vested in ELEMENTS.

8 - Data Privacy

(8.1) The personal data supplied by the Member is required for the operation of ELEMENTS CLUB and related promotions, including for the issue of Rewards and benefits. Personal data may also be used for ongoing research, Programme development, and to communicate news and information to Members. Failure by the Member to provide or keep the required data up to date might result in ELEMENTS CLUB being unable to offer ELEMENTS CLUB membership and associated benefits to that Member. In such case, membership may be suspended.

(8.2) All information is managed in accordance with the Personal Data (Privacy) Ordinance and the MTR Corporation's Privacy Policy. Information may be passed to third parties, suppliers and organisations participating in any joint promotion to facilitate promotion logistics (whereby the corresponding PICS will be displayed in the collaterals), the issue of benefits to Members and the communication of news, information, advertising, and promotional material to Members. ELEMENTS CLUB’s promotions and benefits may also be communicated to Members through SMS. Members may choose not to receive communications unrelated to ELEMENTS CLUB/ MTR Corporation, or other organisations not involved in any Promotion by checking the opt-out box.

(8.3) Members have the right to request a review and correction of any personal data held by ELEMENTS in accordance with the MTR Corporation's Privacy Policy Statement. An administration fee may be charged for processing these requests.

(8.4) The Member is responsible for keeping ELEMENTS CLUB up to date with to his/her correct information (e.g. email address). ELEMENTS CLUB is not responsible for any loss resulting from the Member's failure to notify ELEMENTS CLUB of a change in email address. If a Member changes their email or phone number, the Member must update it through the ELEMENTS APP. Any outdated information may lead to loss of entitlement/benefit.

(8.5) The personal data collection of the Member and their use thereof is subject to the MTR Corporation's Data Privacy Statement.

9 - General

(9.1) Information provided by Members, gathered at the point of Programme enrolment or as a result of the Member's redemption of Rewards, purchases, and other transactions, will be used by ELEMENTS for administering the Programme, marketing planning, research and other related marketing purposes. ELEMENTS may pass such information to its authorised service providers for Programme management, data processing, redemption management, analysis and other purposes related to the Programme. By accepting and participating in the Programme, Members consent to such use.

(9.2) The information may also be used to communicate news and promotions to Members by ELEMENTS. Members have the right to decline to receive such communication by contacting ELEMENTS CLUB or ELEMENTS at any time.

(9.3) ELEMENTS reserves the right to, revise, or suspend the Programme or the terms and conditions herein at any time it deems necessary, with or without notice and without having to give any reasons for doing so. ELEMENTS may (but is not be obliged to) give advance notice to Members in the manner it deems appropriate in the event it decides to cancel, revise, or suspend the Programme or the terms and conditions stated herein.

(9.4) ELEMENTS' failure to enforce a particular term and condition does not constitute a waiver of that term and condition by ELEMENTS.

(9.5) ELEMENTS assumes no responsibility for any claims, losses, costs, expenses or damages of whatever nature resulting from the redemption of the Rewards.

(9.6) Suspected or actual fraud and/or suspected or actual abuse relating to the accumulation of ELEMENTS Points or the redemption of Rewards may result in the immediate forfeiture of accumulated ELEMENTS Points as well as the termination of the Member's participation in the Programme, in addition to any other rights or remedies ELEMENTS may have, whether in law or equity.

(9.7) All questions or disputes regarding eligibility for the Programme or the accrual of ELEMENTS Points, or the redemption of Rewards will be determined by ELEMENTS at its sole discretion.

(9.8) ELEMENTS CLUB membership and Points are not transferable to another Member.

(9.9) The redemption of Rewards with inadequate ELEMENTS Points will not be processed.

(9.10) There is no Trial Period for any Rewards redeemed.

(9.11) ELEMENTS' decision on all matters pertaining to the Programme is final.

10 - Disclaimers

(10.1) ELEMENTS and any of the agents or contractors (if any) that it may use in the execution and management of this Programme do not warrant or represent (either directly or indirectly):

(10.1.1) that participation in and/or access to the whole or parts of the Programme, Programme materials, contents, information and/or functions contained therein will be provided uninterrupted, timely, secure, and error-free.

(10.1.2) that the quality of Rewards Gifts redeemed by the Member will meet the Member's expectations in any respect. Neither does ELEMENTS make any warranty or representation as to the merchantability, suitability of the Reward for the Member's purposes or fitness for use of any Reward redeemed by the Member.

(10.2) Any material downloaded or otherwise obtained through the Internet is done at the Member's own discretion and risk. The Member is also solely responsible for any damage to the Member's computer system or loss of data resulting from such download.

(10.3) Limitation of Liability: Without prejudice to any provisions in the foregoing, the Member expressly understands and agrees that ELEMENTS and its agent(s) shall not be liable for (a) any losses, costs and damages resulting from the Member's enrolment in the Programme, use of the Programme, redemption of the Rewards and use of the Rewards Gifts (b) any indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, data or other intangible losses even if ELEMENTS and its partner(s) have been advised of the possibility of such damage(s) resulting from the Member's participation in the Programme and/or its redemption and use of Rewards.

(10.4) Notice: Notices to Members may be made via either e-mail or phone. The ELEMENTS APP may also provide notices of changes to the terms and conditions or other matters by displaying notices or links to notices to Members generally on the service.

(10.5) Governing Law: The terms and conditions set out herein shall be governed by and construed in accordance with the Laws of Hong Kong Special Administrative Region. For purposes of this paragraph, "person" shall mean a human being or a corporate entity (whether or not having separate legal existence) as the case may be.

(10.6) ELEMENTS reserves the right to amend the terms and conditions at any time without prior notice.

(10.7) In case of any dispute arising from the Programme, the decision of ELEMENTS shall be final.

(10.8) If there are discrepancies between the English and Chinese versions of the terms and conditions, the English version of the terms and conditions as published on the ELEMENTS website shall prevail.
