Travel Light with the ELEMENTS CLUB Locker Service

1. The ELEMENTS CLUB Member Locker Service (the “Locker Service”) is available only to registered ELEMENTS CLUB Members (each a “Member” and collectively, the “Members”) with a valid membership account. Members must present or otherwise provide a valid membership account for verification before using the Locker Service.

2. All items placed in a locker (each a “Locker” and collectively, “Lockers”) are stored entirely at the Member’s own risk. To the fullest extent permitted by the applicable law, ELEMENTS (the “Company”), the building manager and the registered owner for the time being of the premises in which the Lockers are located (the “Owner”) shall not be liable for any loss of or damage to such items, whether arising from negligence or otherwise.

3. The Locker Service is complimentary for Diamond, Platinum and Gold Tier Members. Silver and Red Tier Members may use the Locker Service by 1,500 ELEMENTS Points for the use of Locker on the same day until 8pm. Each eligible Member may use one (1) Locker at a time on the same day, subject to availability. Lockers are allocated on a first-come, first-served basis, and advance reservations are not available.

4. ELEMENTS CLUB Ambassador assistance is available only during the designated service hours:

Monday to Friday: 12:00 noon to 8:00 pm

Saturday, Sunday and Public Holidays: 10:00 am to 8:00 pm

5. Overnight storage is strictly prohibited. If there shall be overnight storage, any items stored in the Locker shall be dealt with in accordance with Clause 10 herein.

6. Members must remove all items upon expiry of the permitted usage period and must not leave, abandon, store or discard any item inside or near the Lockers.

7. The Company may at its sole and absolute discretion prevent, restrict or delay a Member from using a Locker where the Company considers such action necessary to protect the safety, security or interests of any person or property or to prevent risk, loss or damage. To the fullest extent permitted by the applicable law, the Company shall not be liable for any loss or damage resulting from or in connection with such action.

8. A Locker must not be used at any time for:

(a) placing or storing explosives, firearms, ammunition, or any article or material that is flammable, dangerous, offensive, obnoxious or corrosive; or

(b) placing or storing any illegal or unlawful article, or 

(c) any illegal or unlawful purpose.

9. If the Company suspects that a Locker contains any item referred to in Clause 8 or is being used for an illegal or unlawful purpose, the Company may, without notice to the Member, open and inspect the Locker and report the matter to the Police. If the inspection substantiates the Company’s suspicion, the Company may terminate the Locker Service immediately without notice. No fees paid or [membership points / ELEMENTS Points] deducted will be refunded. The Member shall be solely liable for any resulting loss or damage incurred by the Company or any third party, whether or not the Member knew of the use that breached these Terms and Conditions. The Member shall have no claims against the Company for the termination of the Locker Service or for any loss or damage suffered as a result thereof. 

10. If a Locker is used beyond the designated service hours, or if any item remains in a Locker beyond the expiry of the permitted usage session, the Company may open the Locker and remove, store or otherwise handle the item without prior notice. The Company shall not be liable for any loss of or damage to the item arising from or in connection with such action. Retrieval is subject to payment of administrative fees and any other applicable charges prescribed by the Company at its sole and absolute discretion from time to time. Any item not collected within the period specified in Clause 20 may be treated as abandoned property and will be handled in accordance with Clause 20.

11. If a Member forgets the Locker password, the Member must contact an ELEMENTS CLUB Ambassador, present  a valid identity document, and complete the required form. The Member must pay the applicable administrative fees, as prescribed by the Company at its sole and absolute discretion from time to time, before retrieving any item.

12. The Company may at its sole and absolute discretion add to, delete, vary or amend these Terms and Conditions from time to time by posting a notice at or near the Lockers. Any addition, deletion, variation or amendment shall be binding on and deemed accepted by the Member upon the Member’s first use of the Locker Service after the notice is posted.

13. The Company may request proof of identity and membership status from any Member at any time. Failure to provide satisfactory verification may result in refusal, suspension or termination of the Locker Service.

14. The Locker Service is personal to the eligible Member and must not be transferred, assigned, lent or otherwise made available to any third party by any Member. The Company reserves the right to terminate the Locker Service immediately in the event of any unauthorised use at its sole and absolute discretion.

15. Members must use the Lockers with due care and in accordance with these Terms and Conditions. A Member is solely responsible for any damage to a Locker arising from misuse, negligence or improper handling of the Locker and shall be solely liable for all associated repair, replacement and related costs in respect thereof and shall full indemnify and keep indemnified the Company from and against any loss and damage suffered by the Company as a result of the misuse, negligence or improper handling of the Locker by the Member.

16. The Company may amend, suspend, withdraw or terminate the Locker Service at any time without prior notice. The Company’s decision on all matters relating to the Locker Service shall be final and binding on the Members.

17. A Member whose membership has expired, or has been suspended or terminated, or whose membership has been downgraded below Gold Tier, shall immediately cease to be eligible for complimentary use of the Locker Service. Any use by Silver or Red Tier Members requires a deduction of 1,500 ELEMENTS Points under Clause 3. 

18. Administrative fees arising from forgotten passwords, overdue collection, forced opening of Lockers or other related requests will be charged separately. Membership points, vouchers, discounts and other membership privileges may not be used to offset such fees.

19. The Company may refuse the Locker Service to any Member who breaches these Terms and Conditions, misuses the Locker facilities, or engages in conduct that may cause inconvenience, damage or risk to other customers, the Company or the premises. In this regard, the decision of the Company on whether any of the aforementioned events occurred is the final decision and shall be binding on the relevant Member.

20. Any item not collected within fourteen (14) days from the expiry of the permitted usage session, or within any other period determined by the Company at its sole and absolute discretion from time to time, shall be deemed property abandoned by the relevant Member. The Company may, at its sole and absolute discretion, dispose of, destroy, donate, sell or otherwise deal with the item without further notice to the Member and without any obligation to compensate the Member or account for any proceeds.

21. Eligible Members may from time to time receive complimentary Locker usage, membership point rewards or other promotional benefits, subject to the applicable membership programme terms and promotional conditions. The Company may amend, suspend or discontinue any such benefit at its sole and absolute discretion without prior notice.

22. Without limiting Clause 8, the following items must not be stored in a Locker at any time:

(a) cash, precious metals, jewellery, negotiable instruments, valuable documents, passports, identity cards, certificates, securities or other valuable property;

(b) perishable food, beverages, plants, animals, biological materials or any item that may deteriorate over time;

(c) any item that emits an unpleasant odour, leaks, contaminates or causes a nuisance to other users, the Lockers or the surrounding premises;

(d) any oversized item or property that may damage the Locker or surrounding facilities; and

(e) any other item that the Company reasonably considers unsuitable for storage.

Any item stored in breach of this Clause is kept entirely at the Member’s sole risk and responsibility. The Company may remove, store, dispose of or otherwise deal with any such item in accordance with these Terms and Conditions and shall not be liable for any loss of or damage to such item arising from or in connection with such action.

23. The Company may rely on and treat as conclusive evidence of entitlement of any person presenting a valid Locker password, membership account and associated QR code, electronic credential or other approved means of access with the Locker. The Company shall be entitled to permit such person to access to the Lockers and retrieve any stored items therein without further inquiry. The Company shall not be liable for any loss, damage or claim arising from or in connection with any unauthorised access or retrieval resulting from the Member’s disclosure, misuse, theft or loss of those credentials.

24. For purposes including security, safety, crime prevention, operational monitoring and service management, the Locker area may be monitored and recorded continuously by closed-circuit television (CCTV). By using the Locker Service, the Member acknowledges and accepts that the Member’s image and activities within the Locker area may be captured, recorded, stored, used and otherwise processed in accordance with the Company’s applicable privacy policies and all relevant laws and regulations.

25. The Chinese version of these Terms and Conditions is provided for reference only. If there is any inconsistency or conflict between the English and Chinese versions, the English version shall prevail.
